NC Foreclosure Prevention Fund

If a foreclosure action has been filed against you AND you want to stay in your house here are your threshold questions:

If the answer is YES to all three questions you may be eligible for government assistance from the HARDEST HIT FUND ("HHF") as administered by the NC Foreclosure Prevention Fund. If you are eligible, the HHF may bring your mortgage current and assist you in paying your mortgage for the next two (2) years, up to a total of $24,000. And this assistance turns into a complete grant if you stay in your home for the next ten (10) years.

YOUR FORECLOSURE CASE MUST BE CONTINUED AT YOUR 1ST HEARING.

If a foreclosure action has been filed against your property you must act BEFORE YOUR FIRST HEARING DATE!! You have a very small window of opportunity to delay the foreclosure and seek new government funds under the new NC Foreclosure Prevention Fund ("NCFPF") to help you stay in your home. The application time for these new funds can be between 60 - 120 days.

Applying for funding through the Foreclosure Prevention Fund is free. So why should you hire us?

Simple: Obtaining relief funds to bring your mortgage current does you no good if you have already lost your house to foreclosure.

The NCFPF does not provide legal assistance and does not continue your foreclosure case. This is where we come in. We continue your case - usually many times - to delay your foreclosure while you are applying for help from the NCFPF. We help you gather and highlight the financial documentation you need for your application so you are ready with the important facts of your financial situation. We provide answers to your questions at each step along the way with step by step instructions.

Bottom line: we keep your foreclosure case from going to hearing while your application to the NCFPF is pending. We delay your foreclosure, we organize you, we use your data to present your best case at your application and we make certain you understand the process and do it right.

We charge a flat fee and will continue to assist you for a period of one (1) year from the first hearing date of your foreclosure. If you are unsuccessful with your application for new funds from the NCFPF we provide additional options and strategies on what to do next.

We have two (2) methods of assisting you:

(1) $200 - YOU MAKE YOUR OWN COURT APPEARANCES

You go to court but we provide you with the legal documents and instructions needed to continue your foreclosure case while you apply for supplemental government bridge loan funding from the NCFPF. We also provide instructions on the information/documentation you will need for your application to the NCFPF and how to submit the information when applying for new funds. And we help you assess your options in light of your financial circumstances. In short we give you the tools and confidence your need to understand the process better and help you stop your foreclosure while you seek new funding.

(2) $500 - WE MAKE YOUR COURT APPEARANCE FOR YOU

Same as above except you do not have to appear in court. We appear on your behalf before The Clerk of Superior Court to delay the foreclosure. And we handle all communication with the Trustee, the Clerk and other interested parties. The $500 appearance option is only for Haywood, Henderson, Madison and Buncombe counties. We do not make personal appearances beyond this range.

FORECLOSURE SCAMS

The Attorney General has these warnings about foreclosure scams:

"Please note that any program that requires you to pay upfront fees to help you avoid foreclosure is illegal." (source)

"Beware of so-called foreclosure assistance or rescue companies that require payment up front before they "help" you. It’s illegal to charge an upfront fee for foreclosure assistance services in North Carolina." (source)

"Steer clear of foreclosure assistance or rescue companies that want you to make your mortgage payment to them, or who tell you not to talk to your mortgage company or to an attorney." (source)

Foreclosure scams present a very real risk and the AG is correct to warn individuals in foreclosure about them, but the way that some of these warnings are phrased is unfortunate. I am an attorney and I provide legal services. What I am doing is not illegal. I am not a foreclosure "rescue company"; I am not a "program"; I am not an anonymous internet site - I have a real address where you can find me. I do not invest in or take liens against your property as collateral for a fee. I do not, in any way, seek to obtain a legal interest in your property. I do not seek to collect funds from you to pay your mortgage payment for you.

I am interested in keeping people in my service area in their homes and building a strong client base to refer future cases.
