Want to Fight It? Fine. Most folks lose. The conviction rate in Buncombe County around 96%. Here is the truth: if an officer witnessed you driving and decided to charge you with DWI, you will probably be found guilty. Challenging the Intoxilyzer is expensive and rarely successful. And if the officer saw you behind the wheel, he can usually find a legal way to stop you. Therefore I rarely recommend a trial unless there is some question as to who was actually driving the vehicle. So I am aiming this page at folks who want to quietly process their case, pay their fine, and vow to never again find themselves in a blurry little room with a small metal desk, under bright lights, with an officer asking when you last ate something.
Deal with it. In most cases you are much better off processing your DWI case as quickly as possible. Why? Because handling your case the 1st or 2nd time on the calendar saves you time and money. And it offers you a lot more flexibility - you can schedule a time for your plea and avoid having to sit in court for hours waiting for the call of your case.
