Wittstruck Legal

Family Law

Custody, Alimony, Marital Property Division and Transfer of Land

I am Clarke Kent Wittstruck, an Asheville divorce and family law attorney handling cases in Buncombe and Henderson counties. One of my goals is to provide potential clients with as much information as possible to help them determine if I am the right lawyer for them. In building this site I spent a lot of time on the internet looking for content. But the more I looked the more I became convinced I am doing you a better service to simply point you to ncdivorce.com. The site is absolutely amazing. Many of you will have read it prior to coming here. Good. Read it again. My links below are simply to narrow your search by topic.

Separation & Domestic Agreements

During the past 20+ years, I've handled hundreds of domestic cases. And down in the domestic trenches I've discovered a simple truth: good lawyers make your situation better; bad lawyers make your situation much much worse. So choosing a lawyer is important. And the best method is to shop around - talk to as many lawyers as you can, and see if you can determine their approach to domestic work. Me? I want to calm things down and find a compromise. Marriages, especially those under tremendous financial stress, are often difficult works in progress with the true problem being the parties loss of mutual respect and limited communication skills. Rarely is one party right and one party wrong. Instead, both parties lose sight of who their spouse really is or why they ever married. Here refocusing the client and attempting to get them back to an original point of respect for their spouse is not only rewarding professionally, it is smart money. But if this is not possible my job to control my client's anger, focus on the true costs of a domestic war both financial and emotional, and limit disputes to practical solutions rather than rigid philosophical stances. In short: I want you to take a long term view, respect that your spouse probably has a valid perspective, and never give up attempting to find a compromise which will work.
